Disclosure pursuant to art. 13 of Italian Legislative Decree no. 196 of 30 June 2003, as amended - Personal Data Protection Code

This page describes the methods the site uses to manage the personal data of users that visit it. This disclosure is provided, pursuant to art. 13 of Italian Legislative Decree no. 196/2003 of the Personal Data Protection Code, to those who interact with the web services of MM Spa, which can be accessed via internet at www.mmspa.eu, corresponding to the home page of the company’s official website. Said disclosure is provided only for the MM Spa website, not for any other websites that users may view via links. This disclosure is also based on Recommendation no. 2/2001 that the European Data Protection Authority, meeting in the Working Party set up by art. 29 of Directive no. 95/46/EC, adopted on 17 May 2001 to identify certain minimum requirements for collecting personal data online and, in particular, the methods, timeframes, and nature of the information that the data controllers must provide to users when they connect to web pages, irrespective of the purpose of the connection.

Purposes of the processing of personal data and protection of the private sphere

With regard to the processing of data of the users that visit the website or request services that can be accessed via internet at www.mmspa.eu, pursuant to art. 13 of Italian Legislative Decree 196/2003, MM Spa informs you that:

• data provided voluntarily, including e-mail addresses, through the menus of this website (merely by way of example: sending a CV or a request for information) is processed only for the purposes of providing the information and services requested;
• the data shall not be used for other purposes unless expressly provided for, with the express agreement of the data subject.

Types of data processed

Browsing data

During their normal operation, IT systems in general, internet transfer protocols and software procedures governing the operation of this website acquire certain personal data whose transmission is implicit in the use of internet communication protocols.
This is information that is not collected for identification purposes, or to be associated with identified data subjects, but which, due to its nature, could result in the identification of users through processing and association with data held by third parties.
The data may be used only for the purposes of obtaining anonymous statistical information on the use of the website and to check its correct operation. Such data are immediately deleted following the processing. The data may be used by the competent authorities for verifications of liability in the event of possible computer crimes that damage the website.

Data collected

This category of data includes the IP addresses or domain names of computers used by users connecting to the website, the URI (Uniform Resource Identifier) addresses of the resources requested and other parameters relating to the user’s operating system and IT environment.

Processing methods

The personal data shall be processed with the aid of IT, electronic or automated tools, in addition to manual archiving for the time strictly necessary to achieve the purposes for which the data were provided and, in any event, in compliance with the regulatory provisions on the matter. The data will be protected through the adoption of the security measures required by Italian Legislative Decree no. 196/2003 and, in particular, Annex B (Technical Specifications Concerning Minimum Security Measures) to said Legislative Decree, for the purpose of preventing the loss of data or information, illegal or incorrect use and unauthorised access. The personal data collected are processed by the Data Processor indicated below and the assigned staff of MM Spa who have the necessary know-how in carrying out their work. This personal data and/or information may be disseminated and/or communicated to third parties only in the case where this is necessary based on the express requests of the interested users to fulfil the needs linked to conducting the business, to execute the activities related and instrumental to the processing and to the competent authorities in fulfilling legal obligations. The accuracy and truthfulness of the personal data communicated to MM Spa is the responsibility of the person transmitting such data. Any material sent to MM Spa shall be deemed as not confidential in nature.

Data voluntarily provided by the user

The optional, explicit or voluntary sending of e-mail to the addresses indicated on the website results in the subsequent acquisition of the sender’s e-mail address, which is necessary to reply to requests, as well as any other personal data included in the message. Specific summary information will be gradually shown or displayed on the pages of the website set up for specific services on request.

Provision of data is optional

Aside from that specified for browsing data, the provision of personal data by the user is optional. Any refusal to provide the data, however, may make it impossible for the Company to manage its relationship with the data subject.

Data subject’s rights

The subjects of the personal data may, at any time, exercise their rights pursuant to art. 7 of Italian Legislative Decree no. 196/2003. In particular, they have the right to obtain indication of the origin of the data (confirmation of whether the data exist) and the purposes of the processing, to verify the accuracy of the data and request the updating, correction or integration thereof, according to the methods set out by law. Pursuant to said article, data subjects have the right to request the cancellation, transformation into anonymous form or block of data processed in violation of the law, as well as to object to the processing of data for legitimate reasons. Requests pursuant to said art. 7 must be sent to the Data Processor.

Data Controller and Data Processor, and Place of processing of the data

The Data Controller of the personal data is MM Spa, with registered office in Via del Vecchio Politecnico no. 8 , Milan (20121 – MILAN), Italy, in the person of its pro-tempore legal representative. The processing of data connected with the web services of this website is carried out at the headquarters of MM SpA and is overseen only by technical staff of the office assigned to carry out the processing, or by any staff assigned to carry out occasional maintenance.

Law and jurisdiction

The application of the conditions of use is governed by Italian substantive and procedural law. The Court of Milan shall have jurisdiction and competence over any disputes related to these terms and conditions.
